Freight Easy Solutions Pvt. Ltd. (hereinafter referred to as “FSPL”) is a company which is, inter alia, engaged in the business of transportation of goods by road and logistics management.

General Terms and Conditions
Consignments entrusted to Freight Easy Solutions Pvt. Ltd. by you (hereinafter referred to as “Consignor/Sender/Customer” (as the case may be)) for transportation shall be on agreed terms and conditions as specified below.

The Consignor/Sender/Customer acknowledges that, upon their acceptance of the terms and conditions listed below, these terms and conditions shall be binding on them and FSPL.

If the Consignor/Sender/Customer opts not to agree to these terms and conditions or does not wish to avail the services provided by FSPL, they should uninstall the FSPL app from their mobile phones and discontinue the use of FSPL’s services immediately.

Each time that the Consignor/Sender/Customer sends any consignment through FSPL services, the Consignor/Sender/Customer acknowledges the terms and conditions herein.

These FSPL Customer Terms and Conditions apply to the services provided by FSPL currently including, but not limited to, the following services:

Goods Transport by Road (FTL/LTL);

Packers and Movers;

Enterprise Logistics Solutions.

Other than these General Terms and Conditions, the Consignor/Sender/Customer shall be subject to specific terms and conditions for Goods Transport or Packers & Movers depending on the specific services availed.

Warranties and Undertakings
The Consignor/Sender/Customer warrants and undertakes that all Consignments in respect of which FSPL is to provide its services are either owned by the Consignor/Sender/Customer or legally in their possession or under their control, and that they are able to deal with the Consignments as contemplated herein.

The Consignor/Sender/Customer agrees to indemnify FSPL against any loss, damage, or claim made against FSPL arising from any lack of authority of the Consignor/Sender/Customer to contract with FSPL for the Services, or any breach of the warranty or undertaking given under this paragraph.

Amendments and Statutory Compliance
FSPL may vary, amend, change, or update these Terms and Conditions from time to time entirely at its own discretion. You shall be responsible for checking these Terms and Conditions periodically to ensure continued compliance. The continued use of FSPL’s services after any such amendment shall be deemed as your express acceptance of such amended terms.

You agree that FSPL’s services are subject to all prevailing statutory taxes, duties, fees, charges, and/or costs, however denominated, as may be applicable from time to time. It shall be your responsibility to ensure compliance with applicable laws on payment of taxes.

Governing Law and Dispute Resolution
These FSPL Customer Terms and Conditions shall be governed by the laws of India. Subject to the mediation clause specified hereunder, the courts in [Insert City, e.g., Kolkata/Mumbai] shall have exclusive jurisdiction to deal with any matter pertaining to these Terms and Conditions.

Any disputes between FSPL and the Consignor/Sender/Customer that cannot be settled amicably within a period of 30 (thirty) days may be resolved by mediation. A neutral mediator shall be appointed to facilitate the process. The Disputing Parties shall keep the mediation confidential and not disclose any details to any person unless required to do so under applicable law.

Claims and Liabilities (Applicable to ‘Goods Transport by Road)
Reporting Claims: Any claim for accidents or negligence resulting in damage to goods must be made in writing within 24 (twenty-four) hours from the date of receipt. Claims should be sent to:

Documentation: In case of damaged goods, the Consignor/Customer and/or Consignee must provide:

Clear photographs of the damaged goods (and/or packaging in the case of Packers and Movers).

A detailed written description of the damage. In the absence of a claim filed within the stipulated 24-hour window with the required documentation, FSPL shall not be liable to process the claim.

Identity Verification: When claiming a refund or compensation, the claimant must verify their identity as the original Consignor/Customer. FSPL reserves the right to request relevant information to validate the identity. If identity cannot be validated, the request will not be processed.

Limitation of Liability: FSPL’s liability for any loss or damage directly attributable to its agents/contractors is capped as follows:

Goods Transport by Truck/Commercial Vehicle: Liability is limited to the freight amount paid, provided it does not exceed the actual value of the goods or INR 5,000 (Indian Rupees Five Thousand), whichever is lower.

Compliance and Communication:

GST: Customers registered under GST must intimate their GSTIN through the FSPL platform before initiating service.

Deadlines: FSPL will not be liable for compensation if requested information (images, bank details, etc.) is not provided within 2 working days of the initial request.

Blocking of Access: FSPL reserves the right to block a user’s access to its services, in whole or in part, at its sole discretion and without prior notice, for reasons including but not limited to: violation of terms, fraudulent activity, security risks, or non-payment.

Payment Terms
Cash on Delivery (COD): If the Consignor/Customer opts for COD, they must pay the full amount reflected on the FSPL app/platform upon completion of service.

Payments made to the driver-partner are deemed made to FSPL. FSPL is not liable for additional tips or unauthorized payments.

In case of non-payment or deficit payment, FSPL may levy additional charges, suspend the account, and initiate legal recovery actions.

Cancellation: Cancellations made after a vehicle/driver has been allocated may incur a cancellation fee based on company policies, which will be communicated at the time of cancellation.

Invoice Discrepancies: Any discrepancy in invoice value must be reported to FSPL within 7 days of transaction completion. Requests made after this period will not be entertained.

Goods Transport by Road – Terms and Conditions

The following terms and conditions relate to the Goods Transport services provided by Freight Easy Solutions Pvt. Ltd. (FSPL). Goods Transport services may be undertaken by a variety of commercial vehicles including, but not limited to, two-wheelers, three-wheelers, or four-wheelers (Trucks). Consignors availing the Goods Transport services provided by FSPL agree to be bound by these terms and any other general or specific terms and conditions notified by FSPL from time to time.

1. Packaging Instructions
Consignors should adhere to the following packaging instructions to ensure the safety of the cargo:

Complete Coverage: Cover the goods completely, securing all ends and openings with high-quality industrial tape.

Fragile Protection: For fragile items, cover the same in heavy-duty bubble wrap, ensuring corners and edges are well-protected.

Shift Prevention: Use stretch wrap for items that might shift during transit to keep them snugly in place.

Void Filling: For items moved in boxes, fill all voids with crumpled paper, foam, or air cushions to prevent internal shifting. For fragile items, layer the bottom of the box with cushioning material before placement.

Sealing: Use strong, pressure-sensitive packing tape or water-activated tape designed for logistics. Avoid using string or twine instead of tape.

Note: The Consignor understands that using FSPL’s services for fragile items is at the Consignor’s own risk. FSPL shall not be liable for any damage caused to goods due to insufficient or poor packaging by the Consignor.

2. Ownership and Authorization
The Consignor warrants that they are the legal owner or the authorized agent of the owner of the goods/articles being transported and are fully authorized to accept these terms and conditions.

3. Goods Forwarding Note (GFN)
The Consignor is required to provide accurate particulars of the consignment and trip details via the FSPL mobile application or platform while booking. These details constitute the “Goods Forwarding Note.” FSPL shall, upon receipt of the GFN, issue a Goods Receipt/Consignment Note to the Consignor.

4. Legal Compliance and Warranties
The Consignor is responsible for all goods transported through FSPL.

Lawful Use: Consignor will only use FSPL services for legal purposes and shall not commit any illegality or use services for any unlawful purpose.

Accuracy of Description: The Consignor warrants that the description of the consignment conforms accurately to the actual content and does not include any Restricted Items.

Indemnity: The Consignor agrees to fully indemnify FSPL and/or its agents for any loss, damages, costs, expenses, penalties, or fines incurred due to the presence of restricted or illegal materials in the consignment.

5. “Said-to-Contain” Basis
It is expressly understood that all consignments are transported on a “said-to-contain” basis. FSPL shall have the right, but is under no obligation, to verify the contents of the consignment declared by the Consignor. The Consignor undertakes to make a proper, true, fair, and factual declaration regarding the description and value of the consignment.

6. Value Declaration
At the time of booking, the Consignor is required to provide a declaration stating the total value of the consignment and the nature of the materials. This declaration is binding and will be used as the basis for any potential liability claims as per the limits defined in the “Claims” section.

7. Communication and Data Usage
FSPL will use the Consignor and Consignee’s contact information to provide updates regarding the status of the consignment via SMS, push notifications, WhatsApp, and/or email. Additionally:

Feedback: FSPL may contact the Consignor/Consignee to obtain feedback to improve service quality.

Internal Analysis: FSPL may use behavioral information reflected through app usage for internal analysis and targeted marketing. By using the service, the Consignor hereby agrees to such data usage by FSPL.

Indemnity and Restricted Items

Indemnity: The Consignor agrees to indemnify, defend, and hold FSPL and its agents harmless from and against any loss, damages, costs, expenses, penalties, fines, and liabilities of any nature whatsoever incurred or suffered by FSPL or its agents arising out of:

Any acts or omissions by the Consignor.

Breach of any applicable laws or regulations.

Any customer or third-party claims directly or indirectly attributable to the Consignor or the nature of the consignment.

Restricted Items: The Consignor shall not book, and FSPL shall not be obligated to carry, any consignment containing any of the following “Restricted Items”:

  1. Pornographic or Obscene Materials
  2. Dry Ice
  3. Human Body Parts or Remains
  4. Explosives (including fireworks and ammunition)
  5. Firearms and Weaponry (including parts thereof)
  6. Flammable Substances (solvents, fuels, or any item with a flashpoint)
  7. Livestock, Pets, and Animals
  8. Dangerous or Hazardous Goods (as defined by national or international regulations)
  9. Illegal Goods (any item prohibited by central, state, or local law)
  10. Radioactive Materials
  11. Precious Jewelry, Bullion, and High-Value Metals
  12. Currencies, Coins, and Negotiable Instruments (cash, bearer bonds, etc.)
  13. Stones and Gems (loose or set)
  14. Gambling Devices and Lottery Tickets
  15. Fire Extinguishers
  16. Cigarettes, Tobacco Products, and Alcohol
  17. Narcotics, Psychotropic Substances, and Illegal Drugs
  18. Infectious Substances and Biological Specimens

The Consignor acknowledges that the above list is not exhaustive and may be updated from time to time. Updated versions will be made available on the FSPL website or platform and shall be binding upon the Consignor once published or otherwise notified.

Note: Any attempt to ship Restricted Items may result in immediate termination of service, forfeiture of the consignment to law enforcement, and legal action against the Consignor.

Restricted Documents/Articles: Consignors shall not hand over any secure documents or sensitive personal articles for transport. These include, but are not limited to:

  1. Educational Certificates and Marksheets.
  2. Passports and Visas.
  3. Aadhar Cards, Voter IDs, and PAN Cards.
  4. Bank Statements, Credit/Debit Cards, and Cheques.

Currency items and Bearer Bonds. FSPL is not licensed to carry these “Restricted Documents/Articles.” FSPL shall have no liability whatsoever for any loss or damage if such documents are handed over by the Consignor.

Zero Tolerance Policy: If a Consignor attempts to transport illegal, unlawful, or prohibited items through misrepresentation, FSPL reserves the right to report the matter to law enforcement authorities immediately. FSPL maintains a zero-tolerance policy regarding the misuse of its platform for illegal activities.

Destination and Refusal Rights:

Accuracy: Accurate destination addresses must be provided at the time of booking. Address updates cannot be entertained once the vehicle has left the pickup location.

Right to Refuse: FSPL reserves the right to refuse the booking of any consignment without assigning any reason whatsoever.

Inspection and Regulatory Compliance: In the event that law enforcement or regulatory agencies demand an inspection of the consignment during transit, the FSPL driver-partner is authorized to display the goods for verification. The Consignor undertakes to indemnify FSPL for any penalties, fines, or legal costs levied due to the Consignor’s non-compliance with applicable laws or guidelines.

Loading, Delivery, and Return to Origin (RTO)
Weight and Size Limits: Consignors must strictly adhere to the weight and size specifications provided during booking.

Goods must be within legal carriage limits to ensure safe transport.

FSPL reserves the right to reject goods that exceed the specified weight or dimensions.

Consignee Availability: The Consignee must be available at the drop-off location at the communicated time.

Unavailability: If the Consignee is unavailable or refuses the goods, FSPL will contact the Consignor.

Disposal/Return: If the Consignor is unreachable, FSPL may return the goods to the origin, store them, or dispose of them in a practical manner at the Consignor’s cost.

Demurrage: FSPL reserves the right to levy demurrage or incidental charges for extended storage of RTO consignments.

Delivery Scope:

Consignments cannot be dropped at PO Boxes.

Delivery is made to the address provided, not necessarily to a named individual personally.

For buildings with a central receiving area, delivery will be completed at that area only. FSPL does not provide door-to-door transportation unless specifically agreed upon via ancillary services.

Ancillary Services: Load Assist
If the Consignor opts for “Load Assist” (loading/unloading), additional charges will apply.

Presence: The Consignor or an authorized representative must be present during the service.

Exclusions: Load Assist does not include packaging, assembly/disassembly, dismantling, or rope pulling.

Technical Assistance: FSPL does not provide technical help for locking/unlocking appliances or electronics; this must be arranged by the Customer.

Weight Restrictions: Items heavier than 50 kg or those that cannot be safely lifted by two persons (e.g., king-size cots, 5-seater sofas, wardrobes exceeding 7 feet) are excluded from this service.

Force Majeure and Liability Limitations

FSPL shall not be liable for any delay, loss, or damage caused by acts beyond its reasonable control, including but not limited to:

Acts of God (Earthquakes, Floods, etc.).

Force Majeure events (War, Riots, Civil Commotion).

Epidemics or Pandemics.

Strikes, Embargoes, or Political disturbances.

Accidental fire or vehicle accidents not involving negligence by FSPL.

Governmental restrictions or legal seizures.

Personal Liability: The Directors, owners, partners, and shareholders of FSPL shall not be personally liable for any claims or service failures resulting from errors, omissions, or misleading statements from employees, channel partners, or driver-partners.

E-Way Bill and Statutory Compliance
The Consignor is solely responsible for:

Generation: Preparing Part-A and Part-B of the E-way bill.

Accuracy: Ensuring all vehicle and consignment details are true and accurate.

Breakdowns: Updating Part-B of the E-way bill in case of vehicle breakdown or transshipment. FSPL is not responsible for any actions taken by tax or statutory authorities due to E-way bill discrepancies. The Consignor must deal with such authorities directly.

Lien and Disposal of Goods
Right of Lien: FSPL shall have a general and particular lien over all consignments in its possession for any sums due from the Consignor. The Consignor remains liable for all freight and storage charges even while the goods are under lien.

Unclaimed Goods:

If a consignment remains undelivered/unclaimed for over 48 hours, demurrage and warehousing charges will apply.

If a consignment is not claimed within 7 days, FSPL reserves the right to sell or auction the goods to recover its dues (freight, storage, and legal costs).

Part Truck Load (PTL) Services – Terms and Conditions

The following terms and conditions relate specifically to the Part Truck Load (PTL) services provided by Freight Easy Solutions Pvt. Ltd. (FSPL). These terms are in addition to the General Terms and Conditions and the Goods Transport by Road Terms and Conditions detailed above.

Vehicle Type: Part Truck Load services are undertaken exclusively by four-wheeled commercial vehicles.

Agreement: Consignors availing PTL services agree to be bound by the following clauses and any other specific terms notified by FSPL from time to time:

3. Specific Clauses for PTL

3.1 Revised Quotations: In case of any deviation in the weight, dimensions, or route from the original booking, a revised quotation will be provided. The Consignor must accept this revised quotation to proceed with the order. For queries regarding quotations, Consignors may contact our support helpline at [Insert FSPL Support Number].

3.2 Weight Limit: Consignors shall ensure that the individual or cumulative weight of the consignment booked under PTL does not exceed 3,000 kg.

3.3 Advance Booking: Consignors may book in advance based on available time slots. FSPL endeavors to share vehicle and driver details prior to the scheduled pickup. The vehicle shall arrive at the pickup location within the designated time slot as mentioned in the FSPL platform.

3.4 Cancellation: Should the Consignor wish to cancel at the time of pickup, they must contact FSPL support. Any cancellation after a driver has been allocated or has arrived at the location may incur a cancellation fee as per company policy.

3.5 Packaging Responsibility: FSPL does not provide packaging services for PTL. The Consignor is solely responsible for ensuring goods are packed according to the standards mentioned in the “Goods Transport” section. FSPL is not liable for damage resulting from insufficient packaging.

3.6 Labeling and Documentation: * The Consignor must clearly identify, label, and demarcate each item/parcel forming part of the consignment before loading.

The Consignor must submit all necessary documents, including but not limited to the E-way bill, commercial invoice, permits, and licenses required for transit.

FSPL shall not be liable for any loss or damage caused by the failure to appropriately mark goods or the failure to provide accurate documentation.

3.7 Vehicle Allocation and Loading: FSPL reserves the right to allocate a vehicle type at its sole discretion. The Consignor is solely responsible for the loading and unloading of the consignment unless specific “Load Assist” services have been pre-booked and confirmed.

3.8 Delivery Estimates: Arrival times are estimates. Delays may occur due to factors beyond FSPL’s control, such as “no-entry” hours, local festivals, restricted movement regulations, or peak demand. FSPL shall not be liable for any losses arising from such delays.

3.9 Payment: Upon successful transportation, payment shall be made by the Consignee/Consignor as per the selected mode (COD or Prepaid). FSPL reserves the right to update payment methods via the mobile application or official communications.

3.10 Payment Disputes: If a driver-partner demands payment in a manner inconsistent with the app (e.g., demanding extra cash before unloading), the Consignor must inform FSPL within 24 hours. FSPL will review the matter and take appropriate action.

3.11 Incorrect Fulfillment: In the event of incorrect delivery or if the Consignor receives goods belonging to another party, the Consignor must inform FSPL within 48 hours of receipt to facilitate rectification.
